General
'Customer' refers to the person who purchases plants.
'Plant 4 Life' Nursery refers to http://www.plant4lifenursery.com
'GST' refers to Goods & Services Tax chargeable in accordance with the Goods & Services Tax Act 1985
'Plant(s)' refers to products for sale on the 'Plant 4 Life' Nursery website
By using 'Plant 4 Life' Nursery you agree that you have read, understood and accepted these terms and conditions. All Plants supplied by 'Plant 4 Life' Nursery will be in accordance with these terms and conditions and 'Plant 4 Life' Nursery has the right to change these terms and conditions from time to time.
'Plant 4 Life' Nursery has the discretion to decline any order placed or cancel any order for any reason.
'Plant 4 Life' Nursery takes steps to ensure the information provided on its website is correct, however there is no warranty in this regards and 'Plant 4 Life 'Nursery will not be liable for any error or omission.
All photos show a representation of the product, some products will have no image to represent them, this just means 'Plant 4 Life' Nursery are still to collect the appropriate photo for its gallery. There are likely to be variations within a variety.
Price
The customer will pay 'Plant 4 Life' Nursery for the Plant(s) ordered at the price displayed on the website at the time the order is confirmed together with all shipping costs. Plants will not be dispatched until payment is cleared.
The prices of Plants and shipping costs are in New Zealand currency and are inclusive of GST. If 'Plant 4 Life' Nursery is unable to supply the Plant(s) ordered. 'Plant 4 Life Nursery will notify the customer when the plant(s) will be available or refund the Customer's payment if requested.
Product Quality
The customer acknowledges 'Plant 4 Life' Nursery is selling perishable goods. 'Plant 4 Life' Nursery will not be liable for damage to the Plant(s) as a result of it being incorrectly stored or handled after delivery. Any claims for damage incurred in transit must be made directly to the freight company concerned within 2 days of delivery.
Payment
Customers must pay for plants by Internet Banking or Bank Deposit. Once payment is cleared their order will be dispatched.
'Plant 4 Life' Nursery will provide bank account details to the customer upon confirmation of the customers order.
Delivery 'Plant 4 Life' Nursery reserves the right to withhold delivery of any product for any reason whatsoever. Deliveries will be made to the address and location the customer has identified on the order and once left at the specified address the Plant(s) will be deemed to be delivered.
The customer will ensure 'Plant 4 Life' Nursery or its agent is able to deliver where instructed by the Customer. If delivery is not possible through no fault of 'Plant 4 Life' Nursery then 'Plant 4 Life' Nursery reserves the right to cancel the order and charge the customer a cancellation fee of $15.00
'Plant 4 Life' Nursery endeavors to fulfill all orders within seven working days, if a customer has not received an order within Ten working days of having placed the order, they are required to contact 'Plant 4 Life' Nursery.
In the event the customer receives an incorrect order the customer is required to notify 'Plant 4 Life' Nursery within 24 hours of receipt and failure to do so will deem acceptance of the Plant delivered by 'Plant 4 Life' Nursery. If the customer contacts 'Plant 4 Life' Nursery within 24 hours 'Plant 4 Life' Nursery will arrange for collection and replacement of the correct Plant(s) if it is available.
Warranty
While every care is taken to ensure that all plants are true to type, no warranty, implied or expressed can be given as to description or performance.
The plants supplied by us will do well if planted in sites and conditions suitable to that species.
Property and Risk
Title to the plant(s) and risk will pass to the customer on delivery.
Liability and Indemnity, Product Liability & Liability of 'Plant 4 Life' Nursery
'Plant 4 Life' Nursery is not liable for any loss, damage or injury arising directly or indirectly from any Plant(s). 'Plant 4 Life' Nursery is not liable for any consequential injury of any kind arising from the customer's use of 'Plant 4 Life' Nursery or the delivery or failure to deliver Plant(s).
The customer agrees to indemnify 'Plant 4 Life' Nursery against all liabilities, losses, claims and expenses arising directly or indirectly out of the customer's use of the 'Plant 4 Life' Nursery site or delivery or failure to deliver any product.
